What is a Trademark Objection?

A Trademark Objection occurs when the Trademark Examiner raises a query on your application in the Examination Report. It is NOT a rejection, but a request for clarification or legal reasoning on why your brand should be registered.

Most objections are raised under Section 9 (Lack of Distinctiveness) or Section 11 (Similarity to Existing Marks). If you fail to file a legal reply within the 30-day statutory period, your application is deemed abandoned.

Critical Deadline

The time limit to file a legal reply to the Examination Report is strictly 30 days from the date the report is issued. There is no provision for extension.

What Happens If You Miss It?
The Trademark Registrar will declare your application as "Abandoned", and all the filing fees and time spent will be lost. You would need to start the entire process again.
