Frequently Asked Questions

Every company (Private Limited, OPC, Public, Section 8) incorporated on or after 2nd November 2018 having share capital must file INC-20A. LLPs and companies without share capital are exempt.
No. Section 10A explicitly prohibits commencing any business activity or exercising any borrowing power until this certificate is obtained. Doing so invokes heavy penalties.
Late filing is allowed with additional fees (up to 12 times). However, after 180 days, the ROC has reasonable cause to believe the company is not doing business and may initiate action to Strike Off the company name from the register.
